GENERAL TERMS AND CONDITIONS OF SALE
These General Terms and Conditions of Sale (hereafter referred to as GTC) apply to all courses offered by Emma Nobile. Thus, each ordering involves full and unqualified adherence to these GTCs and prevails over any other customer document. Any general or special condition opposed by the Client may not, unless Emma Nobile formally and written acceptance, prevail over these GTCs.
ARTICLE 1 - SCOPE
These General Terms and Conditions of Sale are concluded between Emma Nobile and any individual or legal person purchasing services or products (hereafter referred to as "Customer").
Ordering implies the customer's full and unqualified acceptance of these Terms, regardless of the contrary provisions that may appear on any document from the Customer, including any general terms of purchase.
The Customer acknowledges that he has been made aware of any order of these General Terms and Conditions of Sale and expressly declares that he accepts them without reservation. Emma Nobile, however, reserves the ability to change her General Terms and Conditions of Sale at any time. In this case, the applicable terms will be those in effect on the date of the order.
ARTICLE 2 - SERVICES AND PRODUCTS SOLD
2.1 Services
The services offered are those presented on the Site. These include adult yoga classes and business classes.
These services are offered in the form of a one single class or subscription eligible for a specified number of courses or sessions in person or online (hereafter referred to as the "Course Unit").
The services offered give rise to the booking of one session or several sessions. The booking can be made directly on the Site.
2.2 Products
The products offered for sale on the Site are drawings sold in digital format.
ARTICLE 3 - PRICE
The prices of the products and services offered on the Site are prices indicated in euros and all taxes included.
The prices of the products and services are those in effect at the time of the registration of the order by the Customer.
ARTICLE 4 - ORDERS
4.1 Conditions common to any order
The order is made directly on the Site for final consumers.
Business will need to contact Emma Nobile for a customized quotation through the Site or using the address cuatrovientosonline@gmail.com
Customers who wish to purchase a product or service must:
Fill in the form to indicate all the requested contact information;
Validate the order after checking;
Make the payment under the terms and conditions;
Confirm the order.
Any order expresses irrevocable acceptance of prices and descriptions of products and services, as well as present terms and conditions.
Emma Nobile has, for all stages of access to the Site, the ordering process, delivery or later services, only an obligation of means.
Emma Nobile cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, including a breakdown of service or failure to connect to the Site, an external intrusion or the presence of computer viruses, or in any fact classified as force majeure in accordance with the jurisprudence and the law.
4.2 Special Conditions
The Customer expressly and irrevocably acknowledges and accepts the following:
Medical Certificate and Attestation: The Client acknowledges that he/she has a perfect knowledge of the nature of the physical exercises performed during the courses and sessions he has ordered from Emma Nobile, and certifies on the honour that his physical constitution and state of health allow him/her to practice sport in general, and in particular to practice the activities ordered from Emma Nobile.
The Client relieves Emma Nobile of any claims and legal action relating to injuries or damages caused to his/her person in any way arising from or as a result of the activity carried out. The Client agrees to assume all the risks and consequences associated with the activity carried out.
In any event, the Client undertakes to inform Emma Nobile of his/her medical history and to give Emma Nobile a medical certificate of less than three months when requested. If the medical certificate indicates that the Client is not fit to perform the activity ordered, Emma Nobile is entitled to terminate without notice or compensation the contractual relationship with the Client concerned, which will be reimbursed for all or part of the services ordered according to the services already performed.
Customer Cancellation of a Reservation: Any booking of a course can be cancelled by the Customer up to 24 hours before the time of the course directly on the Site. The corresponding course units may be reused until the expiry date of the book. The cancellation of a reservation out of time cannot in any case give rise to any refund.
Booking cancellation by Emma Nobile: Any booking of a course can be cancelled by Emma Nobile up to 2 hours before the course time by email to the Customer. The corresponding course units may be reused until the expiry date of the book.
Insurance: The Customer recognizes the value of underwriting a personal insurance contract covering personal injury to which their sports practice may expose them in accordance with Article L 321-4 of the Code of Sport.
Safety instructions: Emma Nobile cannot be held liable in the event of an accident resulting from the non-compliance with the safety instructions set out, in particular during the course.
ARTICLE 5 - PAYMENT
The services and products offered on the Site are payable on order.
5.1 Payment terms
The payment of the final Consumer’s purchases is made only by credit card or PayPal.
The payment of Business’s purchase is made by bank transfer indicated in the related invoice.
5.2 Default
Emma Nobile reserves the right to refuse to honour an order for benefits and/or products from a Customer who has not fully paid a previous order or with whom a payment dispute is pending.
ARTICLE 6 - RIGHT OF RETRACTATION AND RETURN
The Customer has fourteen (14) days to request the exchange or refund of products or services ordered without penalty. This period runs from the time the order is confirmed.
In the case of a service, the Client must send an e-mail indicating in a non-equivocal manner his intention to withdraw and specify whether he/she wishes a refund or exchange. They must attach the order number or the purchase invoice.
In accordance with the provisions of the Consumer Code, the right of withdrawal cannot be exercised for a benefit whose performance has begun.
This right of retraction applies only to products and services purchased on the Site.
ARTICLE 7 - INTELLECTUAL PROPERTY RIGHTS
Services and related content (and any work derived or improved from them), including, but not limited to, all texts, illustrations, files, images, software, scripts, graphics, photos, sounds, music, videos, information, content, materials, products, services, URLs, technologies, documentation, trademarks, service marks, trade names and commercial features and interactive features, as well as all rights of ownership, etc. , are Emma Nobile’s property.
ARTICLE 8 - APPLICABLE LAW
These Terms are governed and interpreted in accordance with the laws of France,with the exception of the rules of conflict of laws.
